This Privacy Policy describes how Anaqua, Inc. and its global affiliates (“Anaqua”, “we”, “our” or “us”) collects, uses, shares, secures and disposes of Personal Data from or about our customers and the users of the Anaqua software and services (collectively “Customers”), potential customers, our employees, partners and others with whom we interact. This includes the information we collect and the choices you have concerning the collection and use of such information. When we use the term “Software” we are referring to the Anaqua software for the management of intellectual property and other related software offerings. When we use the term “Services” we are referring to all related services that we offer. Please review this Policy carefully. A. Personal Data Anaqua Collects
As a general principle, Anaqua limits the information collected about you to only what is needed for conducting our business, including using the Anaqua Software and Services and the offering of Software and Services that might be of interest to you. Personal Data (“PD”) means any information that identifies you directly or indirectly. You may choose to provide PD to Anaqua in a number of ways: in person, telephonically, by email, or electronically via our websites. Examples of how you may share PD with us include: registering as a user of the Anaqua Software or Services, requesting a brochure or product information, issuing a RFP, ordering Software or Services from us, responding to Anaqua surveys, attending Anaqua-sponsored events or conferences, or applying for a job.

- Name (including company name for business Customers)
- E-mail address
- Credit card number, financial/bank account number or wire transfer information, including routing numbers and instructions
- Passwords or personal identification codes (PINs)
- Social Security number or other government identification number
- Professional employment information
- Company contact information for business Customers

- IP Address allowing you to access our internet Services
B. How Anaqua uses your Personal Data
Anaqua uses PD to provide Software and related Services in order to meet our Customers needs, including for the following purposes:
- Fulfill our contractual obligations relating to our Software and Services
- Provide Customer service and support;
- Conduct internal business operations in support of our Software and Services including security, accounting, sales and marketing, analytics and research and development;
- Comply with applicable laws, regulation and other legal processes and procedures;
- Establish, exercise or defend our legal rights; and
- Other purposes, where you have provided your consent
Where we use suppliers, service providers and consultants in connection with our business activities, they may have access to your information which they will process on our behalf.
C. Enhancement of the Customer Experience
Because we appreciate the trust you have placed in us, we continually look for ways to enhance your customer experience, both on our web site and with our Software and Services. We customarily host an annual user conference and obtain PD in connection with that event and other events where we participate. From time-to-time, we may notify you about an Anaqua Software or Service using the information you have provided to us either in person, telephonically or electronically by visiting our websites, including information you provide to use our Services. We strive to limit our offers to those we think you would benefit from and appreciate receiving. We want every contact you have with us to be a positive experience. Anaqua complies with all applicable laws and regulations regarding “Do Not Call” Lists. Generally, Anaqua is allowed to contact its Customers, even if the Customers are registered with federal or state Do Not Call Lists, because of our relationship with you. Anaqua will, of course, honor any request to remove your name from our telephone, mail or e-mail solicitation lists and will delete your information from existing files within a reasonable time period. D. Information Disclosed to Third Parties
Anaqua does not sell PD of its Customers to any third parties. In limited circumstances, Anaqua may provide PD to third parties:
- To assist us in developing, promoting, establishing, maintaining and/or providing Anaqua-related Software and Services to you, including joint marketing efforts or promotions, but PD may not be used by the third parties for any other purpose;
- To assist us in establishing accounts, billing, collecting payment, and enforcing the terms and conditions of our Anaqua Software and Services where permitted by law;
- To protect our other Customers from fraudulent, abusive, or unlawful use by you of our Services;
- To comply, when required by law, with court or administrative orders, civil or criminal subpoenas, warrants from law enforcement agencies, federal or state regulatory requirements, mandatory governmental audits, 911 reporting requirements, grand jury investigations, civil or criminal governmental investigations or as otherwise required by law, rule or regulation; and/or
- With your consent.
E. Cookies and Similar Technologies
We use cookies to personalize content and ads, to provide social media features and to analyze our traffic. We also share information about your use of our site with our social media, advertising and analytics partners who may combine it with other information that you’ve provided to them or that they’ve collected from your use of their services. F. Retention of Personal Data
Anaqua retains PD only as long as necessary for Anaqua to comply with business, tax, and legal requirements. For Customers, partners, vendors, and employees, this retention period is likely to be the entire time you are a Customer or employee or otherwise have a relationship with us, depending on the type of PD. After our relationship is terminated, we will keep your PD for a reasonable period, to maintain our records in accordance with the law and our legitimate business needs. We may keep an anonymized form of your PD, which will no longer refer to you, for statistical purposes without time limits, to the extent that we have a legitimate and lawful reason to do so.
G. Applicable Privacy Laws
For the purposes of data protection laws, Anaqua’s Customers are the “data controller” and Anaqua is the “data processor”.
Anaqua complies with all applicable Privacy Laws regarding the collection, use, and retention of personal information including the General Data Protection Regulation (GDPR), Switzerland, the UK, the California Consumer Privacy Act (CCPA), and other applicable jurisdictions (collectively “Privacy Laws”).
Anaqua complies with the EU Standard Contractual Clauses for all onward transfers of PD from the EU. In certain situations, Anaqua may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

H. Security Measures
Anaqua is committed to protecting your PD. Anaqua uses security techniques designed to protect your information from unauthorized access, including firewalls and access control procedures. We have security measures in place to protect against the loss, misuse, and alteration of information under our control, or information that is processed by our Software and under the control of our Customers.
Our policies also limit access to PD to only those employees, contractors, agents, or representatives that require the information to perform their jobs or assist Anaqua with providing Software and Services to you.
Anaqua and/or its hosting providers are at least ISO/IEC 27001and/or SSAE-16/SOC 2, Type 2 certified and whose practice and infrastructure are in compliance with applicable privacy laws and appropriate data transfer mechanisms.
While our goal is to prevent any unauthorized disclosure of PD through our security measures, Anaqua cannot guarantee that an unauthorized disclosure will not occur.

The Anaqua website and Software may facilitate links to other web sites outside of Anaqua. Anaqua is not responsible for the content or privacy policies of other non-Anaqua websites. You should keep this in mind when accessing sites through links. Further, Anaqua may advertise on other websites. The advertising companies placing our ads may use cookies or web beacons to track the effectiveness of our ads. The use of such technology is subject to the privacy policies of the advertising companies, and not this Policy.
J. Your Rights
You may, subject to applicable law, have the following rights concerning your personal data: right of access, right of rectification, right to erasure, right to restrict data processing, right to object against profiling and your right to data portability. If you would like to exercise any of these rights, please contact us.
To the extent that we are relying on our legitimate interests to use your PD, you also have the right to object to such use (unless we can either demonstrate compelling legitimate grounds for the use that override your interests, rights and freedoms or where we need to process the data for the establishment, exercise or defense of legal claims).
We will respond to your privacy rights request consistent with applicable law. For your and the protection of others, we may (depending on the type of request) need to verify your request and identity before addressing your request. Anaqua, Inc. and its operating groups, parent(s), subsidiaries, and affiliates (collectively, “the Company”) are committed to protecting the privacy and security of your personal information. A. Job Applicants:
We collect personal information as defined under the CPRA from job applications. The categories of personal information that we collect include identifiers, protected categories, professional and other employment-related information, and educational and employment history. B. Employees, Emergency Contacts, And Beneficiaries:
We collect personal information, as defined under the CPRA, from our employees as well as their emergency contacts and beneficiaries. The categories of personal information that we collect from employees include identifiers, protected categories, sensitive personal information, geolocation information, professional and other employment-related information, and educational and employment history. The categories of personal information we collect from emergency contacts include identifiers and protected categories. We collect identifiers, sensitive personal information, and information necessary to administer benefit programs from employees’ beneficiaries. To protect the security of your personal information, we will require you to verify your identity by providing us with identifying information such as your personal email address, personal telephone number, home address, and/or other information that we can match with the personal information we haves already collected about you to verify your identity.
You may use an authorized agent to exercise your right to know, delete, or correct your Personal Information. We will require your authorized agent to provide us with either (1) a power of attorney authorizing the authorized agent to act on your behalf or (2) your written authorization permitting the authorized agent to request access to your personal information on your behalf. Further, we will require you or your authorized agent to provide us with identifying information to verify your identity. We may also require you to either verify your own identity directly with us or directly confirm with us that you provided the authorized agent permission to submit the request.
Data Security
While no data security system can fully protect personal information from unauthorized data breaches, we have implemented reasonable safeguards and controls, consistent with its legal obligations under California and other local, state and federal laws. The Company is committed to: (i) seeking to safeguard all personal information that you provide to us; (ii) seeking to ensure that it remains confidential and secure; and (iii) taking all reasonable steps to ensure that personal privacy is respected. All our data is stored in written or electronic form on our servers and computers and in various physical locations. We maintain physical, electronic and procedural safeguards to protect your personal information from misuse, unauthorized access or disclosure and loss or corruption by computer viruses and other sources of harm. We restrict access to personal information to those staff members of the Company and our services providers who need to know that information for the purposes identified in our privacy policy and privacy notices.
We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

The Company does not collect, sell or share personal information for individuals under the age of 16.
